Terms and Conditions for websites provided by for Lami services LTD

 

1. Introduction

These Terms and Conditions govern the use of Lami Services LTD graphic design and web design services. By engaging our services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

 

2. Definitions

- "We," "us," or "our" refers to Lami services.

- "Client," "you," or "your" refers to the individual or entity engaging our design services.

 

3. Scope of Services

Specific details of the services and deliverables will be outlined in a separate estimate.

 

4. Quotes and Pricing

Our pricing is determined on a per-project basis. Quotes are provided based on project scope, complexity, and expected turnaround time. All quotes are subject to change if project requirements are altered. Payment terms will be outlined in the project agreement.


If we are supplying web hosting for your site you will be charged a yearly fee, we will inform you of this cost at the beginning of the project, this may be subject to yearly rise. Alternatively you can choose to link this to your own bank card.


5. Project procedures

By providing Lami with approval of a quotation the client is confirming to have read, understood, and agreed to both the quotation and Lami services terms and conditions which then forms a legally binding contract between Lami services and the client.


The Client must approve their artwork and proofs via return emails, and in doing so the client is confirming that the contract is fulfilled.


6. Intellectual Property

Upon final payment, you will own the intellectual property rights to the final design(s) for the intended use as outlined in the project agreement. We reserve the right to display the work in our portfolio and promotional materials unless otherwise agreed upon.


7. Revisions

Project timelines include a certain number of revisions as specified in the project agreement. Additional revisions may be subject to extra charges. Any requested revisions must be made within a reasonable timeframe.

 

8. Client Responsibilities

a. You agree to provide all necessary information, materials, and feedback promptly. Delays in providing necessary information or feedback may affect project timelines.

b. By approving the proof, the client is approving the quality of all images and the accuracy of the spelling and grammar within the artwork and website. It is the client’s responsibility to check that they are happy with the artwork in its entirety before confirming their proof.

c. Lami Services strongly recommends that the client supplies text and images in their recommended format, to provide the client with an efficient service, and to ensure the highest possible quality of design. If the client chooses to supply any material in a format other than the one advised extra charges may apply.

Lami services LTD will not be held accountable for breaches of copyright from images or artwork supplied by the client, you must ensure that you hold copyright or have permission to use the images.

d. Lami reserves the right to refuse to include any text or images which they feel to be immoral, offensive, or obscene. If materials are included by Lami Services in good faith and turn out to conflict with these standards, they will not be held responsible.

e. If a client holds up a project by up to 14 days, then a 10% of the total project costs will be added to the final total. After 30 days the project will be cancelled.

f. Any extra services required by the client will be subject to further charges.

g. The client is required to nominate a Data Protection Officer who will be named in the privacy policy page of your website. Lami services do not accept any responsibility for breaches of GDPR


9. Payment

Our terms for payment are 30 days from receipt of an invoice. Occasionally we require full or partial payment in advance.

Late payment will incur interest. Under the Late Payment of Commercial Debts (Interest) Act 1998, the daily rate of interest is calculated at 13% per annum on the full outstanding amount.

 

10. Confidentiality

We will treat all information provided by you as confidential and will not share it with third parties, unless required by law or authorized by you. We will also take reasonable steps to ensure the security of your data.


10. Termination

Either party may terminate the project by providing written notice if the other party breaches any material term or condition of the project agreement.


11. Liability

We are not liable for any loss or damage, including but not limited to loss of data, profits, or business interruption, arising from the use of our services or any delays or interruptions in service.

Lami services cannot be held responsible for any loss or damage to artwork once it has been handed to the client. Lami aims to give the client all the security it can by keeping electronic back ups of the artwork for (specified period). However, Lami services strongly advises the client to keep a backup of the artwork themselves to avoid problems.


12. Dispute Resolution

In case of disputes, both parties agree to make reasonable efforts to resolve the issue through negotiation and mediation. If resolution is not reached, the matter may be taken to court in accordance with UK law.


13. Amendments

We may update these terms and conditions from time to time. The most recent version will be available on our website. You agree to be bound by the most current version of our Ts&Cs.


14. Governing Law

These Ts&Cs are governed by and construed in accordance with the laws of England and Wales.
